Who we are

Tsaraforge Digital ("we", "us") is a small independent software studio. These terms cover your use of this website and of the applications we publish, currently Podsmith.

Using this website

This site is informational. There is no account to create, nothing to log in to and no form to submit. You may read it, link to it, and quote it with attribution.

The text, images, logos and branding on this site are ours, and the apps we describe remain our property. Nothing here grants you a licence to our branding.

Apps and purchases

Podsmith is a one-time purchase. There is no subscription and no recurring charge.

We do not sell apps directly. Purchases are made through the app store you downloaded from — currently Apple's App Store. That means:

• Your purchase is a transaction with that store, under that store's terms
• Refunds are handled by the store, not by us — we cannot issue or reverse a payment
• We never see your payment card or billing details

Buying an app gives you a personal licence to use it. It does not transfer ownership of the software, and it does not permit you to resell, redistribute or reverse-engineer it.

Reasonable use

Please do not:

• Attempt to break, overload or gain unauthorised access to our site or services
• Redistribute, repackage or resell our applications
• Use our name or branding in a way that suggests we endorse something we do not

What we do not promise

We would rather be plain about this than bury it. We are a very small team, and:

• The software is provided as is. We do not warrant that it is free of defects or that it will suit your particular purpose.
• We do not offer a guaranteed support response time, an uptime commitment, or a service level agreement.
• We may change, and may eventually discontinue, an app or a feature. Where a change would lose your data, we will say so before it happens.
• Podsmith stores its data on your device. Keeping your own backups is your responsibility, and we cannot recover data from a device we never had it on.

To the fullest extent the law allows, we are not liable for indirect or consequential loss arising from use of the site or the apps. Where liability cannot be excluded, it is limited to what you paid us for the app in question. Some jurisdictions do not allow these exclusions, in which case they apply to you only as far as that law permits, and nothing here removes rights you have as a consumer that cannot be waived.

Privacy

How we handle information is set out in our Privacy Policy, and for Podsmith specifically in the Podsmith Privacy Policy. The short version is that this website collects nothing and Podsmith keeps your data on your own device.

Governing law

These terms are governed by the laws of the State of Tennessee, United States, without regard to its conflict-of-laws rules.

Changes to these terms

We may update these terms as our apps change. The "Last updated" date above moves when we do. Continuing to use the site or the apps after a change means the updated terms apply.
